Thailand SEC Allows Bitcoin and Ethereum ETFs to Trade

The Securities and Exchange Commission of Thailand has completed the rule-making process to allow Bitcoin and Ethereum exchange-traded funds (ETFs) to be listed on the Stock Exchange of Thailand, with the rules set to take effect on October 16, 2026. Initially, products such as depositary receipts linked to overseas cryptocurrency ETFs will not be permitted, and Thai brokers are prohibited from assisting retail investors in investing in overseas cryptocurrency ETFs. However, institutional investors and ultra-high-net-worth individuals are not subject to this restriction. Mutual funds and private equity funds can invest in cryptocurrency ETFs established in Thailand. The relevant ETFs must adopt a passive investment strategy, tracking the prices of the invested crypto assets, and ensure that the average net exposure of a single cryptocurrency reaches at least 80% of the net asset value within each accounting year. Brokers are not allowed to provide margin financing, and fund assets must be custodied by a digital asset custodian regulated by the SEC.
