The Cabinet approved a new procedure for selecting private partners in PPP
The Cabinet of Ministers has approved a new procedure for determining private partners in public-private partnership (PPP) projects. The competition procedures are detailed, a competitive dialogue is provided for complex projects, and consultations with potential investors can be conducted before the announcement of tenders. The new procedure defines the sequence of actions in open tenders, tenders with limited participation, and competitive dialogue, which should make the selection process clearer and more predictable for businesses. Anna Artemenko, Deputy Minister of Economy of Ukraine, noted that the new procedure makes the process of determining a private partner more clear and transparent. The competitive dialogue will be used in complex projects where it is impossible to definitively determine solutions or risk distribution. The procedure includes interaction with applicants and the possibility of refining the competition documentation. Preliminary market consultations are also provided to assess market capabilities and obtain information from potential investors. The government clarified the work of competition commissions, including the possibility of creating permanent commissions and requirements for securing competitive proposals. The changes will ensure clearer rules for participation in PPP projects and the opportunity to discuss complex projects before the final formation of competition conditions.
