U.S. Senate Discusses Requirement for AI Companies to Fulfill Duty of Care
Negotiators in the U.S. Senate are discussing legislation that would require artificial intelligence companies to demonstrate that they have taken reasonable precautions to prevent their tools from causing harm. The proposal aims to grant the U.S. Secretary of Commerce the authority to require developers to provide proof of reasonable steps taken to prevent harm, referred to as a "duty of care," and to authorize the dispatch of government auditors to test relevant products. The related legislation is still under discussion, and what constitutes "reasonable" has yet to be determined. Even if Congress passes the measure, its prospects of becoming law still face resistance. U.S. President Donald Trump has stated that existing authorities are sufficient to regulate tech companies, suggesting he would not sign a bill with new rules. Senate Majority Leader John Thune, Commerce Committee Chairman Ted Cruz, and Democratic Senator Amy Klobuchar are discussing the proposal. Thune stated that Congress could set safeguards against more significant threats without compromising the U.S.'s leading position in the AI race. Klobuchar indicated that she is pushing for bipartisan legislation to oversee the risks of AI models, including requiring developers to collaborate with government experts to validate and test models for safety. Senior Democratic member of the Commerce Committee Maria Cantwell is also involved in the discussions. Negotiators are also discussing that if the government deems certain AI models unsafe and wishes to prevent their release, it could introduce federal court proceedings, allowing companies to challenge that decision in federal court, which would prevent states from enforcing their own laws regarding specific risks associated with AI models.
