Pennsylvania Strengthens Development Standards for Data Centers Exceeding 25MW

The state of Pennsylvania has implemented requirements for self-power procurement, community approval, and cost burdens for large data centers that exceed peak demand of 25MW. Governor Josh Shapiro signed an executive order on the 18th to strengthen the development standards for data centers. Developers must secure new power sources and bear the costs of grid access, transmission, distribution, and network upgrades. Power procurement must be based on resources within the same PJM Interconnection zone, and there is also a requirement to increase the share of continuously available clean power to 32% by 2035. Large data centers will be excluded from the PA permit fast-track program, and existing projects will also be removed from expedited approval eligibility. Developers must meet community notification, environmental standards, employment and training commitments, and local infrastructure investment promises. Industry reactions are mixed, with some opposing the regulatory tightening. Environmental groups and some political factions support the regulatory enhancements. Residents have expressed concerns about noise, air pollution, property value decline, and rising electricity costs, and have initiated petitions against the measures. This action is related to the emerging political issues surrounding power and site regulations for AI data centers in the United States.
