ESMA Orders EU Crypto Providers to Halt Non-Compliant Stablecoin Services
ESMA has directed EU-licensed crypto service providers to stop offering services related to stablecoins that do not comply with MiCA requirements. This directive, issued on October 8, emphasizes that stablecoins issued outside Europe can still pose compliance issues within the EU. The scope includes a wide range of services such as trading, exchange, custody, transfers, order execution, investment advice, and portfolio management. Consequently, exchanges cannot simply resolve regulatory issues by removing one trading pair while continuing other related activities. For stablecoin issuers, distribution through regulated platforms is crucial for liquidity and market reach. Exchanges face the risk of fragmented access, as assets linked to the dollar may require restrictions for EU clients if they do not meet authorization and compliance standards. The opinion outlines supervisory expectations but does not label every stablecoin as non-compliant or announce enforcement against specific platforms. Consumers should not interpret delisting headlines as indicators of a token losing its peg. The primary concern is the legal permission to provide specific services in the EU market, necessitating firms to carefully align their products with regulatory requirements.
